INTRODUCTION AND ACCEPTANCE

Welcome to Acompanhante Photo (“Platform” or “Site”). When you visit, browse, or use the Platform, you (“User”) agree that you have read, understood, and accepted these Terms of Use (“Terms”) and our Privacy Policy.

If you do not agree with any part of these Terms, please stop using the Platform immediately.

1. DEFINITIONS

Platform: the website Acompanhante Photo, its features, APIs, and related services.

Advertiser User: a person over 18 years old who posts ads and creates profiles on the Platform.

Visitor User: any person who visits the Platform to view or search content, without posting ads.

Content: texts, images, videos, audios, or any material posted by Users.

Paid Services: plans and packages that give Advertiser Users more visibility.

Operator: Acompanhante Photo (“we”, “us”, or “Company”).

2. AGE RESTRICTION AND ADULT CONTENT

2.1. This Platform is only for people 18 years old or older. By using it, you confirm you are 18 or older and can legally accept these Terms.

2.2. The Platform contains explicit adult content. If you are under 18, or if this type of content is not allowed where you live, leave now.

2.3. We do not allow minors, even with a parent’s permission or legal emancipation.

2.4. We may ask you to show a photo ID (national ID, driver’s license, or passport) to confirm your age at any time.

3. WHAT THE PLATFORM DOES

3.1. The Platform is only an online advertising directory. It lets Advertiser Users promote their own services independently.

3.2. We are not an agent, employer, or middleman. We do not take part in any deal, meeting, or agreement between Advertiser Users and Visitor Users.

3.3. We do not charge any commission on contacts or meetings between users. We are not responsible for any problems that happen between users.

3.4. Every Advertiser User confirms they work independently and freely, with no employment relationship with the Operator.

4. REGISTRATION AND IDENTITY VERIFICATION

4.1. To post ads, you must create an account with true, accurate, and up-to-date information. You are legally responsible for any false information.

4.2. Identity verification is required before posting any ad. You must:

– Upload an official photo ID (national ID, driver’s license, or passport) showing your tax ID and date of birth;

– Take a live selfie with your document, only through the Platform’s secure panel;

– Record a short anti-fake verification video following the Platform’s instructions.

4.3. Your documents will be used only to verify your age and identity, following our Privacy Policy and Brazilian data protection law (LGPD – Law 13.709/2018).

4.4. If a profile has more than one advertiser, every person must complete the verification process. The profile creator is jointly responsible for any violations.

4.5. Each user can create only one personal account. Fake or duplicate accounts are not allowed.

4.6. You are responsible for keeping your login details safe and for everything that happens in your account.

5. POSTING RULES AND PROHIBITED CONTENT

5.1. When you post content, you confirm that:

– You own the rights, or have written permission from everyone who appears in the material;

– All people shown are 18 years old or older;

– You were not forced in any way to post the ad.

5.2. The following content is strictly forbidden:

• a) Content involving minors: any material that shows, suggests, or promotes sexual activity with minors — including virtual, animated, AI-generated, or drawn images. These cases will be reported to authorities immediately.
• b) Content of others without consent: posting images, videos, or data of people who did not give clear permission (“revenge porn” or similar).
• c) AI-generated media: images, videos, or audio created or edited by AI tools will be treated as fake content, resulting in immediate ban.
• d) Extreme violence or extreme pornography: material showing rape, sexualized violence, non-consensual acts, necrophilia, zoophilia, or life-threatening scenes.
• e) Third-party beneficiary ads: ads posted by someone who profits from another person’s services — this is considered exploitation.
• f) Hate speech and discrimination: racist, xenophobic, homophobic, sexist, or threatening content that promotes violence or discrimination based on any protected characteristic.
• g) External links and competitor promotion: no hyperlinks, QR codes, or references to other platforms or competitors inside ads.
• h) Illegal commercial content: selling medicines, drugs, weapons, or any product or service that is illegal in Brazil.
• i) Promotion of unprotected sex: posting content that promotes or suggests unprotected sexual practices is not allowed. The Platform encourages safe practices and STI prevention.
• j) Doxing and private data exposure: posting personal information about others without their consent (full name, address, phone number, financial details, etc.).

5.3. Ads must be written in Brazilian Portuguese only.

6. MODERATION, REMOVAL, AND BANNING

6.1. We do not review ads before they go live, but we may review, edit, hide, suspend, or remove any content that:

– Breaks these Terms or Brazilian law;

– Contains malware or harmful code;

– Harms other users, third parties, or the Platform’s reputation.

6.2. For serious or repeated violations, we may permanently ban the User (identified by their tax ID), with no refund.

6.3. To reactivate an account that has been suspended for over 90 days, the User must complete a full identity verification again (see section 4.2).

6.4. Content removal or account banning does not give you the right to any compensation or refund.

7. REPORTING CHANNELS

7.1. You can report problems using these contacts:

7.2. Every report will be reviewed within 7 business days. Confirmed illegal content will be removed immediately.

7.3. We will fully cooperate with authorities, sharing access data, metadata, and logs when required by law.

7.4. False or malicious reports made to harm other users will result in suspension or banning of the reporter.

8. REVIEWS

8.1. Visitor Users may post reviews about advertisers, as long as:

The review is based on a real personal experience;

The content is respectful, objective, and relevant;

The reviewer is 18 years old or older.

8.2. Reviews that are offensive, defamatory, fraudulent, or that violate someone’s privacy are not allowed.

8.3. We may review, moderate, or remove reviews that break these rules. Repeated violations may result in suspension or banning.

8.4. By posting a review, you give the Platform a permanent, irrevocable, royalty-free license to display and share that content.

9. PAID SERVICES AND PLANS

9.1. We offer paid visibility plans for Advertiser Users. Prices and features are described on the plans page.

9.2. Payment is made via Pix (or other methods shown at checkout). Your plan activates after payment is confirmed.

9.3. You allow the Platform to promote your ad to increase visibility, at the Operator’s discretion.

9.4. When your paid plan ends, your ad moves to the free basic plan for up to 30 days — your contact number will be hidden. After that, the ad is deactivated automatically if no action is taken. Ads inactive for 365 days are permanently deleted.

10. REFUND POLICY

10.1. In general, payments are non-refundable because the service starts immediately.

10.2. Full refunds are only given if:

Your plan is not activated within 24 hours after payment confirmation;

The Platform is unavailable for a significant part of your paid campaign, with no compensation agreement.

10.3. If your account is temporarily suspended due to a suspected violation, you have 10 days to fix the situation. After that, the unused portion of your payment will be refunded proportionally. Available balances can be refunded within 90 days of the original payment date, using the same payment method.

10.4. No refund will be given after a ban for violating these Terms.

11. IMAGE RIGHTS AND INTELLECTUAL PROPERTY

11.1. By posting content on the Platform, you give the Operator a permanent, worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, distribute, and display that material for the Platform’s operation and promotion.

11.2. You confirm that you own the rights to the content you post and that it does not violate anyone else’s rights.

11.3. Your posts may be indexed by search engines (Google, Bing, etc.) outside of our control. Even after you remove an ad, cached copies may remain online for an unknown period of time.

11.4. All intellectual property of the Platform (brand, design, source code, layout) belongs exclusively to the Operator. Copying or using it without written permission is not allowed.

12. LIMITATION OF LIABILITY

12.1. The Operator, its managers, employees, and partners are not responsible for:

– Harm from interactions between Advertiser and Visitor Users;

– Platform outages, slowdowns, or unavailability;

– Data loss or lost profits;

– Damage from viruses or external attacks;

– The accuracy or quality of content posted by Users.

12.2. The Platform is provided “as is”, with no guarantee of uninterrupted or error-free operation.

12.3. Nothing in these Terms removes responsibility for death, personal injury caused by negligence, or fraud, as required by Brazilian law.

13. INDEMNIFICATION

You agree to protect and compensate the Operator and its representatives from any losses, damages, costs, or expenses (including legal fees) resulting from:

Violations of these Terms;

Content you posted that causes harm to others;

Misuse of the Platform or its services.

14. ETHICAL CODE AND ANTI-EXPLOITATION

14.1. The Operator strongly condemns and actively fights against:

Sexual or labor exploitation;

Human trafficking;

Coercion, threats, or abuse of power to obtain sexual services;

Any form of modern slavery.

14.2. We support the “No means No” principle to prevent violence and harassment. If you experience violence or threats, please contact the relevant authorities.

14.3. Any evidence of exploitation or trafficking will be immediately reported to authorities, along with all available data and records.

15. PRIVACY AND DATA PROTECTION (LGPD)

15.1. We handle your personal data according to our Privacy Policy and Brazilian data protection law (LGPD – Law 13.709/2018).

15.2. We collect only the minimum data needed to provide the service and comply with legal obligations.

16. COOKIES

16.1. The Platform uses cookies to improve your browsing experience, personalize content, and analyze traffic.

16.2. You can turn off cookies in your browser settings, but this may affect some Platform features. Continued use of the Platform means you accept the use of cookies as described in our Privacy Policy.

17. ACCOUNT TERMINATION

17.1. These Terms are valid as long as you use the Platform.

17.2. You can close your account at any time through your profile settings or by contacting support at: [email protected]

17.3. We may suspend or close any account, with or without reason, and will notify authorities if we suspect illegal use. After closure, we have no obligation to keep your data or content.

18. GENERAL PROVISIONS

18.1. Applicable law: These Terms are governed by the laws of Brazil. Any disputes will be handled in the courts of Brazil, and no other jurisdiction applies.

18.2. Changes: We may update these Terms at any time. For major changes, we will notify you via the Platform or by email. Continued use after the update means you accept the new version.

18.3. Partial invalidity: If any clause is found invalid, all other clauses remain fully valid.

18.4. No waiver: If we do not enforce a rule at any time, that does not mean we give up the right to enforce it later.
